You acknowledge that you have read, understand and agree to accept the terms and conditions stated here. If you do not agree with any part of these terms and conditions we ask that you please do not use this website and the services provided.

Access and Use of the Service

Subject to the terms and conditions of this TOS, You may access and use the Service only for Your internal business purposes as contemplated by the Agreement. You shall not:

• license, sublicense, sell, resell, rent, lease, transfer, assign, distribute, time share or otherwise commercially exploit or make the Service available to any third party, other than as expressly permitted by this TOS;
• use the Service to process data on behalf of any third party, or
• use the Service in any unlawful manner or in any manner that interferes with or disrupts the integrity or performance of the Service and its components.

Subject only to the limited right to access and use the Service expressly granted to You under this TOS, all rights, title and interest in and to the Service and its components will remain with and belong exclusively to Travel Planet Network. You shall not modify, adapt or hack the Service to falsely imply any sponsorship or association with Travel Planet Network, or otherwise attempt to gain unauthorized access to the Service or its related systems or networks.

You are responsible for all information, data, text, messages or other materials that You post or otherwise transmit via the Service. You are responsible for maintaining the confidentiality of Your login and account and are fully responsible for any and all activities that occur under Your login or account.

Travel Planet Network reserves the right to access any or all Your accounts in order to respond to Your requests for technical support. We shall maintain appropriate administrative, physical and technical safeguards for protection of the security, confidentiality and integrity of Your data. We will not disclose Your data except if compelled by law or if permitted by You.

You understand that the technical processing and transmission of the Service, including Your content, may be transferred unencrypted and involve:

• transmissions over various networks;
• changes to conform and adapt to technical requirements of connecting networks or devices and
• transmission to Travel Planet Network’s third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to operate and maintain the Service. Travel Planet Network will use reasonable efforts to publish on the site or notify You of any planned downtime of the Service.

The failure of Travel Planet Network to exercise or enforce any right or provision of this TOS shall not be a waiver of that right. You acknowledge that this TOS is a contract between You and Travel Planet Network, even though it is electronic and is not physically signed by You and Travel Planet Network, and it governs Your use of the Service and takes the place of any prior agreements between You and Travel Planet Network.

Account and Partner Terms

You must be 18 years or older to use this Service.
You must be a human. Accounts registered by “bots” or other automated methods are not permitted.
You must provide your legal full name, a valid email address, and any other information requested in order to complete the signup process.
You are responsible for maintaining the security of your username and password. Travel Planet Network cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
You are responsible for all Content posted and activity that occurs under your account (even when Content is posted by others who have accounts under your account).
You must not misrepresent yourself or take on the identity of someone else while using this service.
You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
You are responsible for purchasing and forwarding a custom domain to your partner ID URL, as to ensure that all of your consumer orders are tracked so that you receive your commission payout. If you choose to solely use your Partner ID URL (i.e. www.mytravelplanet.com/#partnerID), we are not responsible for non-tracked orders and you forfeit any commissions that fail to fall under your account.

Violation of any of these agreements will result in the termination of your Account. While Travel Planet Network prohibits such conduct and Content on the Service, you understand and agree that we cannot be responsible for the Content posted on the Service and you nonetheless may be exposed to such materials. You agree to use the Service at your own risk.

General Conditions

Your use of the Service is at Your sole risk. The service is provided on an “as is” and “as available” basis.

Technical support is only available via email, phone and online chat during business days 8:00 – 16:00 PDT.

You understand that Travel Planet Network uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Service.

You must not modify, adapt or hack the Service or modify another website so as to falsely imply that it is associated with the Service, Travel Planet Network, or any other Travel Planet Network service.

You may not reverse engineer or reuse source code that is in public view. This includes any and all javascript.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, computer code that powers the Service, or access to the Service without the permission by Travel Planet Network.

We may, but have no obligation to, remove Content and Accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.
Verbal, physical, written or other abuse (including threats of abuse or retribution) of any Travel Planet Network customer, employee, member, or officer will result in immediate account termination.

You understand that the technical processing and transmission of the Service, including your Content, may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.
You must not upload, post, host, or transmit unsolicited email or “spam” messages. This also includes Opt-in Opt-out mail programs. We have the right to stop your account if these rules are broken.

You must not transmit any worms or viruses or any code of a destructive nature.
If your bandwidth usage exceeds monthly limit, or significantly exceeds the average bandwidth usage, we reserve the right to immediately suspend your account or throttle your file hosting until you can reduce your bandwidth consumption or upgrade your account.

Travel Planet Network does not warrant that (i) the service will meet your specific requirements, (ii) the service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the service will be accurate or reliable, (iv) the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations.

You expressly understand and agree that Travel Planet Network shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Travel Planet Network has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the service; or (v) any other matter relating to the service.

You, the user, acknowledge that all content included on this website, including the information, data, software, photographs, graphs, video, typefaces, graphics, music, sounds, images, illustrations, maps, designs, icons, written and other material and any and all items that may be considered content in the subsequent future are intellectual property and copyrighted works of Travel Planet Network. All individuals deemed to have infringed on copyrights and intellectual property held by Travel Planet Network will be prosecuted under the law.

Limitations of Liability

This website is for your personal and non-commercial use in accordance with the terms and conditions of this agreement, and as a condition of your use you warrant and represent to Travel Planet Network that you will not use this website for any illegal purpose or for any purpose that is prohibited by the terms and conditions of this agreement. Specifically, you may not modify, copy, distribute, transmit, publish, display, license, create derivative works from or sell any product, services, information or software obtained from this website.

Travel Planet Network will not be held responsible or liable under any circumstances for any misinformation, loss or damage which may occur due to accessing the Private Travel Beoking Engine called ActivateTravelSavings.com. This disclaimer of liability applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, negligence, or under any other cause of action.

Indemnity

You hereby agree to indemnify and hold, Travel Planet Network harmless for any and all costs, damages, expenses, liabilities or obligations (including defense costs and attorneys fees) that it may incur as a result of claims asserted against it by any third party that directly or indirectly arise or otherwise relate to your access to and use of the Materials, including without limitation your failure to comply with the terms of this Agreement or any License Agreement.

To the extent permitted by law, the services and information on this website are provided “AS IS,” and without warranty, and all warranties of any kind, either express or implied, including, but not limited to, the implied warranties or merchantability, fitness for a particular purpose, or non-infringement, are hereby disclaimed, and you hereby waive all such warranties.

Users of this web site and program materials should not rely upon any content displayed on this web site when making business, financial, personal or other decisions. Furthermore, we do not endorse the opinions of third parties expressed on this web site or on linked web sites.

Exclusive Venue

These Terms and Conditions are governed by the internal substantive laws of the United States and State of Nevada, without references to rules governing the choice of laws. Jurisdiction for any claims arising under this Agreement shall lie exclusively with a court of competent jurisdiction located within the County of Clark located in the State of Nevada, and you irrevocably consent to the jurisdiction of such court. Any legal action concerning these Terms or this website must be brought within one (1) year after the claim or cause of action arises and must be brought in the State of Nevada where our corporate headquarters are located.

Travel Planet Network reserves the right, without prior notice, to discontinue, change, modify, or amend any of these terms, conditions, notices and certificate programs relating to or offered by this website. The terms and conditions listed on each certificate are subject to change without notice. All users of Travel Planet Network and/or ActivateTravelSavings.com is responsible for the terms and conditions as they apply on the date of purchase or activation. No refunds will be provided for any Travel Planet Network activation code that is modified or discontinued.

The failure of Travel Planet Network to exercise or enforce any right or provision of the these Terms and Conditions shall not constitute a waiver of such right or provision. The Terms and Conditions constitutes the entire agreement between you and Travel Planet Network and govern your use of the Service, superseding any prior agreements between you and Travel Planet Network (including, but not limited to, any prior versions of the Terms and Conditions).
